How we will use the information about you

The Children Act 1989 requires all Local Authorities to establish a record of disabled children and young people (up to the age of 19) in their areas.

Who else will we share your information with?

We will only use this information to create a record of your child's disability.

We will share your anonymised information with;

  • Cornwall Council's Children, Schools and Families in order to help improve services for children and to map where those with SEND live.

Your data will be held within a Cornwall Council approved secure network and premises, hosted by sub-contractors Open Objects and will not be processed outside of the UK. Access to your information will only be made to authorised members of staff who are required to process it for the purposes outlined in this privacy notice.

Our sub-contractor detailed in this privacy notice will also maintain the same levels of security that we do which are set out in the contract we have with them.

How long will you keep this information for?

Your information will be kept for 5 years after registration, with the expectation of the record editor to update the record every 12 months; otherwise the record will be deleted.

What are my data rights?

Your personal information belongs to you and you have the right to:

  • Be informed of how we will process it
  • Request a copy of what we hold about you and in commonly used electronic format if you wish (if you provided this to us electronically for automated processing, we will return it in the same way)
  • Have it amended if it's incorrect or incomplete
  • Have it deleted (where we do not have a legal requirement to retain it)
  • Withdraw your consent if you no longer wish us to process
  • Object to us using it in relation to a legal task or in the exercise of an official authority

Why do you need my information?

You have asked us to register your child on the Disabled Children's Record, so we need your completed application form in order to set this up. Without this we will not be able to provide you with the service. We also need your information;

  • To contact you when it is time for your annual update or if we require further information in the application process.
  • To contact you with relevant news and updates about special educational needs and disability (SEND) services for children and young people within Cornwall
  • To assist in service planning.

What happens when my child turns 13?

Within one year of their 13th birthday, we will need verbal or written consent to host their details, providing that they understand the terms written in this statement.

In accordance with The General Protection Regulation (GDPR) if the information that you are providing is for a young person aged 13 years or over at the time of completing this form then you must seek permission from the young person to provide this information if they have the capacity to understand the information we hold.

One of the following options must be identified when the child turns 13:

  • My child is 13 years or older at the time of submitting this information and has the capacity to understand the information held.
  • My child is 13 years or older at the time of submitting this information and does not have the capacity to understand the information held.
  • My child is under 13 years at the time of submitting this information. I understand that I will be contacted to confirm whether they have the capacity to understand the information held once they have turned 13 years old.

If the young person turns 13 after the information has been submitted in accordance with the GDPR we will need to contact the young person to obtain their permission within 1 year of their 13th Birthday.
